Terms of Service

Article 1 (Application)

1. These Terms apply to every relationship between the user and the operator of MADE CENTRAL ("we", "us") concerning the use of the web application "MADE CENTRAL" (the "Service"). For details about the operator, please see the "Notation based on the Act on Specified Commercial Transactions".
2. In addition to these Terms, the Privacy Policy, the "Notation based on the Act on Specified Commercial Transactions" and other rules apply to the Service.
3. [Test operation and change of name] The Service is currently in test operation, and the name of the Service ("MADE CENTRAL") as well as its logo and other designs may change without notice in the future. Even if the name or similar is changed, these Terms remain in force and continue to apply.
4. [Browsing without logging in] Users who do not hold an account or who are not logged in may still view certain pages that we permit, such as pages setting out the fees and plan details of the Service.

Article 2 (User registration and authentication)

1. Creating an account (including verification by a valid email address) and logging in are required in order to post data, download data, and create or join threads on the Service.
2. Users shall register using true and accurate information and shall manage their login credentials strictly at their own responsibility.
3. [Handling of accounts with unverified email addresses] When registering with an email address and password, you must complete email verification via the link in the verification email sent after registration. If verification is not completed within a certain period (24 hours from registration), the unverified registration information (account) may be deleted automatically for the purposes of housekeeping and security. In that case, you may register again with the same email address. This measure applies only to accounts whose email verification has not been completed, and never to verified accounts.
4. Where a minor uses the Service (including subscribing to the free plan or a paid plan), the minor shall do so only after obtaining the comprehensive consent of their legal representative (such as a person with parental authority). When a minor uses the Service, they are deemed to have obtained their legal representative's consent to the use of the Service and to these Terms.
5. [Deception by a minor] If a minor uses the Service by pretending to have their legal representative's consent when they do not, or by pretending to be of full age, or otherwise uses deception to make us believe that they have full legal capacity, that minor may not rescind their use of the Service or any legal act accompanying it (including payment for a paid plan).
6. [Ratification by use after reaching adulthood] If a user who was a minor when they started using the Service uses the Service after reaching the age of majority, that user is deemed to have ratified all legal acts relating to their use of the Service while they were a minor.
7. [Authentication via external linked services] Where a user logs in to the Service using an external linked service such as Google (an "External Service"), the user shall comply with the terms of use of that External Service. We bear no responsibility whatsoever if the Service becomes unusable due to suspension of, or a malfunction in, the External Service account.
8. [Loss of an External Service account, and the recommendation to set a password] A user who logs in only via an External Service (that is, who has not set a password) will be unable to log in to the Service if their External Service account becomes unusable through deletion, suspension or similar. In such a case the user is often also unable to receive email sent to their registered address (including password reset email), and since there is no means of identity verification, we are under no obligation to restore the account and bear no responsibility for any damage or disadvantage arising from the inability to restore it, unless caused by our wilful misconduct or gross negligence. To prepare for this, we recommend that you set a password in advance from the settings screen (and change your registered address to one you can receive mail at, if necessary). A user who has become unable to log in for the reason set out in this paragraph may, regardless of whether they are on a free or paid plan, apply through the Service's contact desk, and only where we can confirm their identity by reasonable means, carry out the procedure to delete their account (withdraw). If that user subscribes to a paid plan, they may also carry out the procedure to cancel the paid plan (stop automatic renewal).
9. [Password reset, its limits, and measures where login is impossible] If a user forgets their password, they may use the password reset function we provide. However, for account security, use of that function is limited to three times per user per year. A "year" means the period starting in the month in which the user registered for the Service and running until the same month in the following year. Once the limit is reached, the user cannot reset their password or log in to their account until the starting month of the next year arrives. A user who has become unable to log in because of this limit may, regardless of whether they are on a free or paid plan, apply through the Service's contact desk, and only where we can confirm their identity by reasonable means, carry out the procedure to delete their account (withdraw). If that user subscribes to a paid plan, they may also carry out the procedure to cancel the paid plan (stop automatic renewal). We bear no responsibility whatsoever for any damage or disadvantage arising during a period in which the user could not use the Service because of the limit in this paragraph, unless caused by our wilful misconduct or gross negligence.
10. [Temporary access restriction after consecutive failed logins] To maintain security and prevent unauthorized access such as brute-force attacks, if a user fails to log in repeatedly within a short period, we may automatically restrict (temporarily lock) logins to that account for a certain period. The restriction is lifted automatically after that period, and login becomes possible again. We bear no responsibility whatsoever for any damage or disadvantage caused by this measure, unless caused by our wilful misconduct or gross negligence.
11. [Setting or changing a password while logged in] While logged in, a user may change their password, and a user who has no password because they registered via an External Service may set one. For security, entering a verification code sent to the registered email address is required for the setting or change procedure. Once the verification code has been entered, we treat verification of that registered email address as complete. In addition, for account security and to prevent misuse, changing a password while logged in is limited to five times per user per year ("year" has the same meaning as in the provision on password reset above, starting in the month in which the user registered for the Service). However, the act of a user who has no password because they registered via an External Service setting a password for the first time is not included in (not counted towards) this number. Even once the limit is reached, you can still log in to the Service and use its other functions, but you cannot change your password until the starting month of the next year arrives. In addition, when you change or reset your password, all devices logged in to that account are signed out automatically for account security. Please sign in again with your new password (a user who has no password and sets one for the first time is not signed out).
12. [Changing the registered email address, and its limits] While logged in, a user may change their registered email address from the settings screen. For security, entering a verification code sent to the new email address is required for the change procedure. For account security and to prevent misuse, changing the registered email address is limited to three times per user per year ("year" has the same meaning as above, starting in the month in which the user registered for the Service). Even once the limit is reached, you can still log in to the Service and use its other functions, but you cannot change your registered email address until the starting month of the next year arrives.
13. [Two-factor authentication (2FA) and recovery codes] A user who uses two-factor authentication shall store the recovery codes issued during setup safely at their own responsibility. If login to the account becomes impossible because the recovery codes have been lost or for a similar reason, we are under no obligation to restore the account and bear no responsibility whatsoever for any resulting damage. A user who has become unable to log in for the reason set out in this paragraph may, regardless of whether they are on a free or paid plan, apply through the Service's contact desk, and only where we can confirm their identity by reasonable means, carry out the procedure to delete their account (withdraw). If that user subscribes to a paid plan, they may also carry out the procedure to cancel the paid plan (stop automatic renewal).

Article 3 (Fees, plans, limits, upgrades and related matters)

1. The Service offers the free "Free plan" and the paid subscriptions "Standard plan" (990 yen per month, tax included) and "Pro plan" (2,200 yen per month, tax included). The rights under each plan are as follows.
   • Free plan
     Uploads / downloads: up to 10 each per month
     Maximum size per file: 10 MB
     Thread rights: cannot create or join threads (may only view public threads and download data from them)
   • Standard plan
     Uploads / downloads: up to 30 each per month
     Maximum size per file: 100 MB
     Thread rights: may create up to 5 public threads per month (cannot create private threads). May join both public and private threads
   • Pro plan
     Uploads / downloads: up to 70 each per month
     Maximum size per file: 100 MB
     Thread rights: may create up to 10 threads per month in total, public and private combined. May join both public and private threads
2. [Checking your remaining allowance] Users may check their current remaining allowance for "uploads", "downloads" and "thread creation" at any time from My Page or another designated screen.
3. [Bonus allowance] Each time 3D data uploaded by a user (excluding data uploaded to private threads) is downloaded by 10 different users, that user receives 10 additional uploads and 10 additional downloads in their current usage cycle.
   • The user count is tracked independently for each item of data.
   • The conversion into a bonus and the added allowance are limited to the current usage cycle (until the next renewal date; for the Free plan, until the end of the current month).
   • The maximum number of times this bonus may apply within one usage cycle is once for the Free plan, twice for the Standard plan and three times for the Pro plan.
4. [Upgrading a plan] Where a user changes to a higher plan (upgrade), the change takes effect immediately. For the period from the time of the change until the next renewal date, the difference between the old and new plans is calculated pro rata and charged immediately. The next renewal date (the anniversary date) does not change.
5. [Downgrading or cancelling a plan] Where a user changes to a lower plan (downgrade) or cancels a paid plan (stops automatic renewal), the functions of the current plan are retained until the next renewal date even after the procedure is complete. The new plan applies once the next renewal date arrives (in the case of a downgrade to the Standard plan, payment is taken on the same day), and the usage limits switch over at that point.
6. [Failed payment and withdrawal] If payment for a paid plan fails, the limits of the Free plan apply immediately. If a user deletes their own account (withdraws), the plan is cancelled at the same time. At that point, the user may choose whether data and posts they made in the past remain in anonymized form or are erased completely from the system. However, if the operator forcibly deletes an account because of a violation of these Terms or similar, all of that user's data will be erased completely.
7. [Restriction on re-registration after withdrawal] If a user deletes their own account (withdraws), then in order to prevent misuse and to keep the system healthy, the email address used at the time of withdrawal cannot be used for new registration (including registration by email address and registration via an External Service) for 7 days after withdrawal. This restriction is also shown in advance on the withdrawal screen. This measure does not apply to the automatic deletion by the system of accounts with unverified email addresses set out in Article 2.
8. [Retention period for view history] A user's data view history on the Service is stored and displayed for the most recent month only; older history is erased in due course.

Article 4 (Conditions for using threads, and the duty to consent when creating or joining)

When creating or joining a thread, users are obliged to understand the following conditions on the designated confirmation screen and to give express consent within the system. Without consent, threads cannot be created or joined. Users may view each of the following confirmation items (consent items) at any time from the designated screen, both after creating and after joining a thread.

1. Items to confirm and consent to when creating a thread (common to public and private)
   • [Deleting a thread cannot be undone]
     You can delete a thread you created at any time, but once deleted, the thread itself and all data and exchanges with participants inside it cannot be restored. Please keep this in mind.
   • [Thread management rights (deleting replies and banning members)]
     The thread owner may delete any reply in the thread, including uploaded data, at any time at their own discretion. They may also permanently ban a participant who disrupts the thread (banning cannot be undone). A banned user is thereafter treated as follows in that thread:
     • Public threads: the user may only view the thread and download data from it, and can no longer reply, post data or quote.
     • Private threads: for confidentiality, the user can no longer view the thread, see its contents or obtain any data from it (other than the thread title and the owner's user name).
2. Items to confirm and consent to when joining a thread (common to public and private)
   • [Consent to moderation by the thread owner (deletion and banning)]
     To keep the thread on purpose and in order, the thread owner may, at their own discretion and without prior notice, delete your replies (including uploaded data) or permanently ban you from the thread with no way back. Please understand this in advance.
   • [Consent to the thread being deleted]
     The thread owner may delete the thread without notice, at their own discretion. Your posts will be deleted along with it. Please understand this in advance.
3. Notice about deletion of a post (common to public and private)
   If a thread participant's reply or uploaded data is deleted by the thread owner, the following notice is displayed the next time they open that thread.
   • Title: Notice: your post has been deleted
   • Body: The thread owner has deleted your reply (or your uploaded data). This thread is moderated by its owner under the terms you agreed to beforehand. Please understand this in advance. If you continue to take part, please keep your posts in line with the purpose of the thread.
4. Specific conditions for public threads (common to creating and joining)
   • Purpose (no commercial development): this thread is for developing data that other users are allowed to use free of charge for personal use, and will not be used to develop commercial products intended for sale or similar purposes.
   • Consent to collaboration and modification: you allow other participants to freely modify the data you post in the thread and incorporate it into their work, for the purpose of completing the product.
   • Consent to releasing the result free of charge: you agree that the product data finally completed in this thread will be published on this platform to other users free of charge and for personal use only (you cannot claim exclusive rights to it afterwards).
   • No rights infringement, no dangerous items: you will not develop or share data that infringes the rights of others, or data for dangerous items.
   • Consent to penalties in case of violation: you agree that if a violation of these Terms comes to light, the operator may delete the thread or the data and delete your account (forced withdrawal) without prior notice, and that malicious cases may be subject to legal action and claims for damages.
5. Specific conditions for private threads (when creating)
   • Consent to the title being public, and caution about confidential information: the thread title and the owner's user name are visible to all users. Take care not to include confidential information in the title.
   • Managing the invite code: share the invite code only with users you want to let in, and change (reissue) the code if it leaks.
   • Purpose (commercial development): you understand that this thread is a place for developing and collaborating on products intended for sale or similar commercial purposes.
   • No unauthorized use of data from any source: unauthorized use of anything from any source is strictly prohibited, not only within this platform but also 3D models from external sites and the like. You will not use any data for which you do not hold full permission for commercial use.
   • Important warning about trademark and design registration: even external material labelled as allowing commercial use is in most cases prohibited from being registered as an exclusive right. Before registering any right, you will thoroughly confirm at your own responsibility that the data is entirely original and that the rights are clear.
   • Rights and profit sharing are your own responsibility: you agree that the rights to the finished product, the sharing of profits and any trouble are to be resolved among the participants, and that the operator is in no way involved and bears no responsibility.
   • Consent to penalties in case of violation: you agree that you may be subject to the same measures, legal action and claims for damages as set out in the preceding paragraph.
6. Specific conditions for private threads (when joining)
   • Confidentiality and no leaking of the invite code: you will not disclose the data and information shared in the thread, or the invite code, to anyone outside without the owner's permission.
   • As to the purpose of commercial development, the prohibition of unauthorized use of data, the warning about trademark and design registration, rights and profit sharing being your own responsibility, and consent to penalties in case of violation, you consent to the same items as when creating a thread.

Article 5 (Posting and downloading data, and ownership of rights)

When uploading or downloading data, users are obliged to give express consent within the system to warrant and comply with the following. Without consent, data cannot be sent or received.

1. [File formats and upload limits]
   • Supported file formats: the files that can be uploaded are of five kinds — "STL", "OBJ", "3MF", "STEP/STP" and "IGES/IGS". However, only the three formats "STL", "OBJ" and "3MF" support preview in the browser (the 3D viewer and thumbnails in list screens). For "STEP/STP" and "IGES/IGS" files, only an icon indicating the file format is displayed.
   • Limit on the number of files: up to 5 files may be uploaded at once per thread reply. For a standalone post that does not belong to a thread, only 1 file may be uploaded per post.
2. [Rights to delete data and threads, and warnings]
   • Deleting a thread: the thread owner may delete a thread they created at any time (thread participants may not).
   • Deleting replies and individual files: thread participants may delete their own replies, and may also delete individual files within a reply.
   • Deleting a standalone post: users may delete their own standalone posts, but individual files cannot be deleted on their own; only the whole post can be deleted.
   • Confirmation on deletion, and no restoration: in every case, a confirmation screen stating "This action cannot be undone. It cannot be restored." is shown when you perform a deletion. Once deleted, data cannot be restored under any circumstances.
3. Confirmation when uploading to a normal post or a public thread
   • The data is entirely original: it is not a copy of an existing character or of someone else's data.
   • The data does not infringe third-party rights: you warrant that it does not infringe copyright, design rights, trademark rights or similar.
   • No duplicate posting: it has not already been uploaded elsewhere within this platform.
   • Deleting the data, publishing it elsewhere, and restrictions afterwards: you are free at any time to delete this data or to publish or sell it on other sites. However, even if you delete the data from this platform, for example because you later want to distribute it exclusively yourself, you cannot retroactively revoke the personal use rights of users who have already obtained it.
   • Permission for personal use by other users: you allow other users to use it for personal purposes, excluding commercial use (there is no option to allow commercial use).
   • Use of data in public threads and permission to quote: for data uploaded to a public thread, you allow other users to use it (modify and incorporate it) within that thread. In addition, if you allowed quoting when uploading ("Allow this data to be quoted in public threads" on a normal post, or "Allow the attached files to be quoted" in a public thread), other users may quote this data into public threads, and you allow it to be used in the same way in the public thread it is quoted into.
   • No dangerous items, harmful programs or illegal data: the data contains no harmful programs such as viruses, and is not a weapon or other data that could be misused for crime or to harm others.
   • Consent to measures in case of violation: you consent to immediate deletion of your account, legal action and claims for damages in the event of a violation of these Terms.
4. Confirmation when downloading from a normal post or a public thread
   • Personal use or thread purposes only (no commercial use): you will use it only to enjoy personally, and never for sale or business use (this does not apply when you use it inside the public thread you downloaded it from, or when you use data marked as quotable for collaboration in a public thread).
   • No redistribution or re-publishing: you will not distribute the downloaded data to third parties, for example by publishing it on other sites or re-uploading it within this platform.
   • No passing the work off as your own, no undue claim of rights: you will not pretend that you created it, nor obstruct the legitimate use of others.
   • Disclaimer (use at your own risk): you accept sole responsibility for any damage, such as equipment failure or injury, caused by defects in the data, virus infection, or trouble during printing, and you will hold neither the operator nor the creator of the data responsible.
   • How the download allowance is consumed: your monthly download allowance is consumed at the moment you perform a download (including individual downloads and bulk downloads). Even if you then cancel in the save dialog on your device, or the file is not saved completely because the connection was interrupted, the count cannot be restored for technical reasons. Please understand this in advance.
   • Consent to measures in case of violation: you consent to immediate deletion of your account, legal action and claims for damages in the event of a violation of these Terms.
5. Confirmation when uploading to a private thread
   • The data is complete and cleared for commercial use: it is either entirely original or consists solely of material explicitly licensed for commercial use.
   • No unauthorized reuse of data from within the platform: data published by other users within this platform is for personal use only, so you will not upload it as commercial development data for this thread without permission.
   • Important warning about trademark and design registration: if you have incorporated external material, you understand that there is a high risk that exclusive rights cannot be obtained, and you will thoroughly confirm the rights involved.
   • Commercial licence, confidentiality, and what happens if the data is deleted: you allow the members of this thread to use and modify this data for the purpose of the thread (developing a commercial product). You can delete the data at any time, but deleting it does not retroactively revoke that permission. You will also treat it as confidential information and will not publish it externally without permission.
   • No dangerous items, harmful programs or illegal data: the data contains no harmful programs such as viruses, and is not a weapon or other data liable to misuse.
   • Consent to measures in case of violation: you consent to immediate deletion of your account, legal action and claims for damages in the event of a violation of these Terms.
6. Confirmation when downloading from a private thread
   • Use for the purpose of the thread and confidentiality: you will use it only to develop a commercial product, and will not leak or publish it externally without the creator's permission.
   • No unauthorized redistribution, no selling the data on its own: you will not distribute it to third parties without permission, nor sell the data on its own.
   • Rights and profit sharing are your own responsibility: trouble such as the sharing of sales profits is to be resolved between the parties concerned, and the operator bears no responsibility.
   • Disclaimer (use at your own risk): you accept sole responsibility for damage caused by defects in the data, virus infection or trouble during printing, and will hold neither the operator nor the creator of the data responsible.
   • Consent to measures in case of violation: you consent to immediate deletion of your account, legal action and claims for damages in the event of a violation of these Terms.

Article 6 (Prohibited conduct)

In using the Service, users must not engage in the following conduct.

• Conduct that violates laws and regulations or public order and morals
• Conduct that infringes the intellectual property rights, privacy or reputation of others
• Posting obscene, violent or discriminatory content
• Posting files containing harmful programs such as viruses
• Developing, sharing or posting data liable to violate laws such as the Act Controlling the Possession of Firearms or Swords and Other Such Weapons (for example data for 3D-printable weapons or dangerous items)
• Using public data on the Service (which is for personal use only) for commercial purposes without permission, including bringing it into a private thread
• Placing an excessive load on the systems or networks of the Service, or unauthorized access such as scraping
• Improperly circumventing the bot countermeasures we put in place (such as CAPTCHA)
• Improperly circumventing limits in ways we do not intend, such as repeatedly posting meaningless data solely to lift a restriction
• Unfairly reporting other users on the basis of false facts
• Transferring, lending or trading an account on the Service, or rights and obligations under these Terms, to a third party
• Any other conduct that we judge to be inappropriate

Article 7 (Measures against violations of these Terms)

If a user violates the consent items applying when creating or joining a thread or when sending or receiving data, violates any other provision of these Terms, or acts in a way we judge to be inappropriate, we may take the following measures without prior notice. We bear no responsibility whatsoever for any damage caused to the user thereby.

1. Deletion of the thread or the uploaded data
2. Restriction of use of the Service, or suspension or immediate deletion of the account (forced withdrawal). Where an account has been deleted by the operator as a penalty, re-registration for the Service from the same IP address is not permitted under any circumstances.
3. Forced cancellation of a paid plan

Article 8 (Disclaimers, administration and statistical information)

1. We are under no obligation to review or monitor the content of 3D data posted by users in advance, and we make no warranty whatsoever that such data is complete, safe, or does not in fact infringe the rights of third parties. In the unlikely event of trouble, it shall be resolved at the responsibility and expense of the user who posted the data.
2. [Collection and administration of statistical information] We may collect and view statistical information for purposes such as operating and administering the Service. However, as a rule we do not actively monitor posts and data inside private threads, except where there is a report of a violation of these Terms or similar.
3. We bear no responsibility whatsoever for the use of data downloaded through the Service, for trouble in joint development between users, or for the results of actually printing downloaded data on a 3D printer or similar.
4. The Service is at a stage of continuous development and updating, and functions may be added, changed or suspended, or unexpected defects may occur. We bear no responsibility whatsoever for any resulting damage or for the loss of data in the database.
5. [Exception under the Consumer Contract Act, and cap on damages] The disclaimers in these Terms do not apply where damage is caused to a user by our wilful misconduct or gross negligence. Furthermore, where we bear liability for damages towards a user, for example under the Consumer Contract Act, the amount of compensation is capped at the total fees we have received from that user over the most recent 12 months (or 990 yen for a user who has never subscribed to a paid plan).

Article 9 (Changes to, suspension of, and termination of the Service)

1. We may change, temporarily suspend, or terminate the provision of all or part of the Service at our convenience.
2. Where we terminate the Service, we will as a rule give notice at least one month in advance.
3. We may erase all data upon termination of the Service. Users shall back up their data in advance at their own responsibility.
4. For users subscribing to a paid plan, automatic renewal stops as of the termination of the Service. Fees for the month of termination will not be calculated pro rata or refunded.
5. We bear no responsibility whatsoever for any damage caused by a change, suspension or termination under this Article.

Article 10 (Changes to these Terms)

We may change these Terms where we judge it necessary. The revised Terms take effect from the time of effect specified in the announcement made on the Service.

Article 11 (Exclusion of anti-social forces)

Users represent that they are not an organized crime group, a member or quasi-member of such a group, a company related to such a group, a corporate racketeer, a group engaging in criminal activities under the pretext of conducting social campaigns, a crime group specialized in intellectual crimes, or any equivalent person ("Anti-Social Forces"). If it emerges that a user falls under Anti-Social Forces, we may take measures such as immediate deletion of the account without prior notice.

Article 12 (Severability)

Even if any provision of these Terms, or part of it, is held invalid or unenforceable under laws or regulations, the remaining provisions of these Terms continue to apply in full force.

Article 13 (Governing law and jurisdiction)

These Terms shall be interpreted in accordance with the laws of Japan. In the event of a dispute concerning the Service, the summary court or district court having jurisdiction over our location shall be the exclusive court of first instance by agreement.
