Terms of Service

Article 1 (Application)

1. These Terms apply to every relationship between the user and the operator of MADE CENTRAL ("we", "us") concerning the use of the web application "MADE CENTRAL" (the "Service"). For details about the operator, please see the "Notation based on the Act on Specified Commercial Transactions".
2. In addition to these Terms, the Privacy Policy, the "Notation based on the Act on Specified Commercial Transactions" and other rules apply to the Service.
3. [Continuous development and change of name] The Service is officially in operation, but it is at a stage of continuous development and improvement, and the name of the Service ("MADE CENTRAL") as well as its logo and other designs may change in the future. Even if the name or similar is changed, these Terms remain in force and continue to apply.
4. [Browsing without logging in] Users who do not hold an account or who are not logged in may still view certain pages that we permit, such as pages setting out the fees and plan details of the Service.

Article 2 (User registration and authentication)

1. Creating an account (including verification by a valid email address) and logging in are required in order to post data, download data, and create or join threads on the Service.
2. Users shall register using true and accurate information and shall manage their login credentials strictly at their own responsibility.
3. [Handling of accounts with unverified email addresses] When registering with an email address and password, you must complete email verification via the link in the verification email sent after registration. If verification is not completed within a certain period (24 hours from registration), the unverified registration information (account) may be deleted automatically for the purposes of housekeeping and security. In that case, you may register again with the same email address. This measure applies only to accounts whose email verification has not been completed, and never to verified accounts.
4. Where a minor uses the Service (including subscribing to the free plan or a paid plan), the minor shall do so only after obtaining the consent of their legal representative (such as a person with parental authority) in advance. A minor user represents that they have obtained their legal representative's consent in using the Service; however, this paragraph does not restrict any right of rescission granted to minors by the Civil Code or other laws.
5. [Deception by a minor] If a minor uses the Service by pretending to have their legal representative's consent when they do not, or by pretending to be of full age, or otherwise uses deception to make us believe that they have full legal capacity, that minor may not rescind their use of the Service or any legal act accompanying it (including payment for a paid plan).
6. [Ratification by use after reaching adulthood] If a user who was a minor when they started using the Service uses the Service after reaching the age of majority, that user is deemed to have ratified all legal acts relating to their use of the Service while they were a minor.
7. [Authentication via external linked services] Where a user logs in to the Service using an external linked service such as Google (an "External Service"), the user shall comply with the terms of use of that External Service. We bear no responsibility whatsoever if the Service becomes unusable due to suspension of, or a malfunction in, the External Service account.
8. [Loss of an External Service account, and the recommendation to set a password] A user who logs in only via an External Service (that is, who has not set a password) will be unable to log in to the Service if their External Service account becomes unusable through deletion, suspension or similar. In such a case the user is often also unable to receive email sent to their registered address (including password reset email), and since there is no means of identity verification, we are under no obligation to restore the account and bear no responsibility for any damage or disadvantage arising from the inability to restore it, unless caused by our wilful misconduct or gross negligence. To prepare for this, we recommend that you set a password in advance from the settings screen (and change your registered address to one you can receive mail at, if necessary). A user who has become unable to log in for the reason set out in this paragraph may, regardless of whether they are on a free or paid plan, apply through the Service's contact desk, and only where we can confirm their identity by reasonable means, carry out the procedure to delete their account (withdraw). If that user subscribes to a paid plan, they may also carry out the procedure to cancel the paid plan (stop automatic renewal).
9. [Password reset, its limits, and measures where login is impossible] If a user forgets their password, they may use the password reset function we provide. However, for account security, use of that function is limited to three times per user per year. A "year" means the period starting in the month in which the user registered for the Service and running until the same month in the following year. Once the limit is reached, the user cannot reset their password until the starting month of the next year arrives (we do not take any measure that blocks login itself; however, a user who has forgotten their password and cannot reset it will in practice remain unable to log in). A user who has become unable to log in because of this limit may, regardless of whether they are on a free or paid plan, apply through the Service's contact desk, and only where we can confirm their identity by reasonable means, carry out the procedure to delete their account (withdraw). If that user subscribes to a paid plan, they may also carry out the procedure to cancel the paid plan (stop automatic renewal). We bear no responsibility whatsoever for any damage or disadvantage arising during a period in which the user could not use the Service because of the limit in this paragraph, unless caused by our wilful misconduct or gross negligence.
10. [Temporary access restriction on login attempts] To maintain security and prevent unauthorized access such as brute-force attacks, if a user fails to log in repeatedly within a short period, we may automatically restrict (temporarily lock) logins to that account for a certain period. Likewise, regardless of whether the attempts succeed, if logins are attempted repeatedly within a short period in a way that risks placing an excessive load on our servers, we may automatically restrict logins for a certain period in the same way. The restriction is lifted automatically after that period, and login becomes possible again. We bear no responsibility whatsoever for any damage or disadvantage caused by this measure, unless caused by our wilful misconduct or gross negligence.
11. [Validity period of your logged-in session] To keep your account secure, a logged-in session has a limited lifetime: you are logged out automatically once a certain period (currently 7 days) has passed since you last used the service. The period is extended while you keep using the service, so users who visit regularly do not need to log in again each time. We may change this period as security requires.
12. [Setting or changing a password while logged in] While logged in, a user may change their password, and a user who has no password because they registered via an External Service may set one. For security, entering a verification code sent to the registered email address is required for the setting or change procedure. Once the verification code has been entered, we treat verification of that registered email address as complete. In addition, for account security and to prevent misuse, changing a password while logged in is limited to five times per user per year ("year" has the same meaning as in the provision on password reset above, starting in the month in which the user registered for the Service). However, the act of a user who has no password because they registered via an External Service setting a password for the first time is not included in (not counted towards) this number. Even once the limit is reached, you can still log in to the Service and use its other functions, but you cannot change your password until the starting month of the next year arrives. In addition, when you change or reset your password, all devices logged in to that account are signed out automatically for account security. Please sign in again with your new password (a user who has no password and sets one for the first time is not signed out).
13. [Changing the registered email address, and its limits] While logged in, a user may change their registered email address from the settings screen. For security, entering a verification code sent to the new email address is required for the change procedure. For account security and to prevent misuse, changing the registered email address is limited to three times per user per year ("year" has the same meaning as above, starting in the month in which the user registered for the Service). Even once the limit is reached, you can still log in to the Service and use its other functions, but you cannot change your registered email address until the starting month of the next year arrives.
14. [Two-factor authentication (2FA) and recovery codes] A user who uses two-factor authentication shall store the recovery codes issued during setup safely at their own responsibility. If login to the account becomes impossible because the recovery codes have been lost or for a similar reason, we are under no obligation to restore the account and bear no responsibility whatsoever for any resulting damage. A user who has become unable to log in for the reason set out in this paragraph may, regardless of whether they are on a free or paid plan, apply through the Service's contact desk, and only where we can confirm their identity by reasonable means, carry out the procedure to delete their account (withdraw). If that user subscribes to a paid plan, they may also carry out the procedure to cancel the paid plan (stop automatic renewal).

Article 3 (Fees, plans, limits, upgrades and related matters)

1. The Service offers the free "Free plan" and the paid subscriptions "Standard plan" (990 yen per month, tax included) and "Pro plan" (2,200 yen per month, tax included). The rights under each plan are as follows.
   • Free plan
     Uploads / downloads: up to 10 each per week
     Maximum size per file: 10 MB
     Thread rights: cannot create or join threads (may only view public threads and download data from them). However, threads already joined while on a paid plan are governed by [Threads already joined, after a downgrade] in this Article.
   • Standard plan
     Uploads / downloads: up to 80 each per week
     Maximum size per file: 100 MB
     Thread rights: may create up to 10 public threads per week (cannot create private threads). May join both public and private threads
   • Pro plan
     Uploads / downloads: up to 170 each per week
     Maximum size per file: 100 MB
     Thread rights: may create up to 20 threads per week in total, public and private combined. May join both public and private threads
2. [Counting period for the limits (definition of one week)] The limits on uploads, downloads and thread creation set out in the preceding item are all counted per week, and the amount you have used returns to zero at the start of each week. In these Terms, "one week" means the period that begins at 00:00 on Monday, Japan Standard Time (JST), and ends immediately before 00:00 on the following Monday. This counting period applies to all users in the same way, regardless of plan type or the subscription and renewal dates of a paid plan. Billing for paid plans continues to be monthly and is not linked to this counting period.
3. [Checking your remaining allowance] Users may check their current remaining allowance for "uploads", "downloads" and "thread creation" at any time from My Page or another designated screen.
4. [Bonus allowance] Each time 3D data uploaded by a user (excluding data uploaded to private threads) is downloaded by 5 different users, that user receives 10 additional uploads and 10 additional downloads.
   • The user count is tracked independently for each item of data. Downloads performed by the user themselves are not counted.
   • The week in which downloads are counted and the week in which the allowance is added are different. A bonus based on the number of people who downloaded during a given week (as defined in the preceding item) is added to the upload and download allowance for the following week. The added allowance expires at the end of that following week and is not carried over any further.
   • The maximum number of times this bonus may apply within one week is once (up to 10 additional) for the Free plan, twice (up to 20 additional) for the Standard plan and three times (up to 30 additional) for the Pro plan.
   • This maximum is determined by the plan in effect during the week in which the bonus is actually added, not the plan during the week in which the downloads were counted. Accordingly, if the plan is downgraded before that following week, the allowance added is capped at the maximum of the plan after the downgrade.
5. [Upgrading a plan] Where a user changes to a higher plan (upgrade), the change takes effect immediately. For the period from the time of the change until the next renewal date, the difference between the old and new plans is calculated pro rata and charged immediately. The next renewal date (the anniversary date) does not change.
6. [Downgrading or cancelling a plan] Where a user changes to a lower plan (downgrade) or cancels a paid plan (stops automatic renewal), the functions of the current plan are retained until the next renewal date even after the procedure is complete. The new plan applies once the next renewal date arrives (in the case of a downgrade to the Standard plan, payment is taken on the same day), and the usage limits switch over at that point.
7. [Threads already joined, after a downgrade] Even where the Free plan comes to apply under the preceding paragraph or the following paragraph, a user may continue to view the threads they had already joined while on a paid plan, and to download the data within those threads, for as long as their membership record is retained. This treatment exists so that work already carried out together does not become impossible to review, and it applies notwithstanding the Free plan thread rights set out in paragraph 1. The following points apply, however.
   • The user cannot make new posts (replies or data uploads) to those threads, and cannot create new threads or join further threads.
   • The number of downloads available and the maximum size per file are those of the plan in effect at the time (the Free plan).
   • This paragraph does not apply where the user leaves the thread of their own accord or is removed by the thread creator, because the membership record is then no longer retained. For a private thread, rejoining after leaving requires a plan that permits joining, in addition to entering the invite code.
8. [Failed payment and withdrawal] If payment for a paid plan fails, the limits of the Free plan apply immediately. If a user deletes their own account (withdraws), the plan is cancelled (automatic renewal stops) at the same time. At that point, the user may choose whether data and posts they made in the past remain in anonymized form or are erased completely from the system. However, if the operator forcibly deletes an account because of a violation of these Terms or similar, all of that user's data will be erased completely.
9. [Scope and processing of cancellation on withdrawal] The cancellation in the preceding paragraph covers every subscription of that user held with our payment processor (Stripe), including subscriptions whose payment is overdue and cases where several subscriptions exist. When you withdraw, we cancel on the basis of the current subscription status obtained from the payment processor rather than the records in our own database, and we do not delete the account until we have confirmed that cancellation is complete. If we cannot confirm completion because of a communication failure or similar, we retain the information needed for cancellation and retry the procedure automatically. We do not warrant that no charge will arise after withdrawal; in the unlikely event that a charge arises after withdrawal for reasons attributable to us, we will refund that charge.
10. [Identity confirmation when withdrawing] Deleting your account (withdrawing) cannot be undone, and depending on your choice your posts and data are erased permanently. For this reason, you must enter your current password to confirm your identity when you withdraw. Users who sign in only through an External Service and have not set a password must first set a password from the settings screen before withdrawing (setting a password requires entering a verification code sent to your registered email address). This is the same method of identity confirmation as for changing your registered email address and for enabling two-factor authentication, and it exists to prevent an irreversible withdrawal from being carried out by someone who merely has temporary access to a signed-in device. The treatment of users who can neither log in nor set a password, for example because they have lost their External Service account, is governed by Article 2, paragraphs 8 and 9.
11. [Restriction on re-registration after withdrawal] If a user deletes their own account (withdraws), then in order to prevent misuse and to keep the system healthy, the email address used at the time of withdrawal cannot be used for new registration (including registration by email address and registration via an External Service) for 7 days after withdrawal. This restriction is also shown in advance on the withdrawal screen. This measure does not apply to the automatic deletion by the system of accounts with unverified email addresses set out in Article 2.
12. [Retention period for view history] A user's data view history on the Service is stored and displayed for the most recent month only; older history is erased in due course.

Article 4 (Conditions for using threads, and the duty to consent when creating or joining)

When creating or joining a thread, users are obliged to understand the following conditions on the designated confirmation screen and to give express consent within the system. Without consent, threads cannot be created or joined. Users may view each of the following confirmation items (consent items) at any time from the designated screen, both after creating and after joining a thread.

1. Items to confirm and consent to when creating a thread (common to public and private)
   • [Deleting a thread cannot be undone]
     You can delete a thread you created at any time, but once deleted, the thread itself and all data and exchanges with participants inside it cannot be restored. Please keep this in mind.
   • [Thread management rights (deleting replies and banning members)]
     The thread owner may delete any reply in the thread, including uploaded data, at any time at their own discretion. They may also permanently ban a participant who disrupts the thread (banning cannot be undone). A banned user is thereafter treated as follows in that thread:
     • Public threads: the user may only view the thread and download data from it, and can no longer reply, post data or quote.
     • Private threads: for confidentiality, the user can no longer view the thread, see its contents or obtain any data from it (other than the thread title and the owner's user name).
2. Items to confirm and consent to when joining a thread (common to public and private)
   • [Consent to moderation by the thread owner (deletion and banning)]
     To keep the thread on purpose and in order, the thread owner may, at their own discretion and without prior notice, delete your replies (including uploaded data) or permanently ban you from the thread with no way back. Please understand this in advance.
   • [Consent to the thread being deleted]
     The thread owner may delete the thread without notice, at their own discretion. Your posts will be deleted along with it. Please understand this in advance.
   • [Leaving a thread of your own accord]
     A participant may leave a thread they have joined at any time of their own accord, whether the thread is public or private. Leaving is handled as follows.
     • Even after you leave, anything you posted to that thread, including uploaded data, remains in the thread as part of the shared work. Leaving does not delete it.
     • Public threads: after leaving, you can still view the thread and download data from it, and you may join again.
     • Private threads: once you leave, you can no longer view the thread, see its contents or obtain its data (other than the thread title and the creator's user name). To join again, you must enter the invite code once more.
     • The thread creator cannot leave. So that no thread is left without anyone to manage it, creators should archive or delete the thread instead.
     • A banned user cannot leave (that is, cannot delete their participation record), because doing so would erase the record of the ban and allow them to join again.
     • To prevent excessive load on our servers from repeatedly joining and leaving in a short time, leaving is limited to 10 times per hour (joining is limited to 20 times per hour). Once the limit is reached, you cannot leave a thread until a certain time has passed.
3. Notice about deletion of a post (common to public and private)
   If a thread participant's reply or uploaded data is deleted by the thread owner, the following notice is displayed the next time they open that thread.
   • Title: Notice: your post has been deleted
   • Body: The thread owner has deleted your reply (or your uploaded data). This thread is moderated by its owner under the terms you agreed to beforehand. Please understand this in advance. If you continue to take part, please keep your posts in line with the purpose of the thread.
4. Specific conditions for public threads (common to creating and joining)
   • Purpose (no commercial development): this thread is for developing data that other users are allowed to use free of charge for personal use, and will not be used to develop commercial products intended for sale or similar purposes.
   • Consent to collaboration and modification: you allow other participants to freely modify the data you post in the thread and incorporate it into their work, for the purpose of completing the product.
   • Consent to releasing the result free of charge: you agree that the product data finally completed in this thread will be published on this platform to other users free of charge and for personal use only (you cannot claim exclusive rights to it afterwards).
   • No rights infringement, no dangerous items: you will not develop or share data that infringes the rights of others, or data for dangerous items.
   • Consent to penalties in case of violation: you agree that if a violation of these Terms comes to light, the operator may delete the thread or the data and delete your account (forced withdrawal) without prior notice, and that malicious cases may be subject to legal action and claims for damages.
5. Specific conditions for private threads (when creating)
   • Consent to the title being public, and caution about confidential information: the thread title and the owner's user name are visible to all users. Take care not to include confidential information in the title.
   • Managing the invite code: share the invite code only with users you want to let in, and change (reissue) the code if it leaks.
   • Purpose (commercial development): you understand that this thread is a place for developing and collaborating on products intended for sale or similar commercial purposes.
   • No unauthorized use of data from any source: unauthorized use of anything from any source is strictly prohibited, not only within this platform but also 3D models from external sites and the like. You will not use any data for which you do not hold full permission for commercial use.
   • Important warning about trademark and design registration: even external material labelled as allowing commercial use is in most cases prohibited from being registered as an exclusive right. Before registering any right, you will thoroughly confirm at your own responsibility that the data is entirely original and that the rights are clear.
   • Rights and profit sharing are your own responsibility: you agree that the rights to the finished product, the sharing of profits and any trouble are to be resolved among the participants, and that the operator is in no way involved and bears no responsibility.
   • Consent to penalties in case of violation: you agree that you may be subject to the same measures, legal action and claims for damages as set out in the preceding paragraph.
6. Specific conditions for private threads (when joining)
   • Confidentiality and no leaking of the invite code: you will not disclose the data and information shared in the thread, or the invite code, to anyone outside without the owner's permission.
   • Confirmation that this is not a substitute for a non-disclosure agreement (NDA): The confidentiality in this paragraph is no more than a promise between participants; it is not a confidentiality agreement to which we are a party. These Terms say nothing about the scope of the confidential information, the exceptions (information already in the public domain, information held before joining, information lawfully obtained from a third party, disclosure required by law or by court order, and so on), the duration, the consequences of a breach, or the response to a leak, and we bear no responsibility whatsoever for confidentiality between participants. If you handle trade secrets or commercially important information, please conclude a separate non-disclosure agreement between the participants.
   • As to the purpose of commercial development, the prohibition of unauthorized use of data, the warning about trademark and design registration, rights and profit sharing being your own responsibility, and consent to penalties in case of violation, you consent to the same items as when creating a thread.

Article 5 (Posting and downloading data, and ownership of rights)

When uploading or downloading data, users are obliged to give express consent within the system to warrant and comply with the following. Without consent, data cannot be sent or received.

[Meaning of "quotation" in this Article] In these Terms and on the screens of the Service, "quotation" means a function provided by the Service by which data posted by another user is incorporated into your own post or into a public thread, within the scope permitted in advance by the person who posted it. It is a different concept from "quotation" under Article 32 of the Japanese Copyright Act. Use of this function neither means that the requirements of that Article are met, nor restricts any use permitted under that Article.

1. [Limit on posting actions] To prevent excessive load on our servers from posting in large volumes within a short time, and to prevent threads from being flooded with posts, posting to a thread (including text-only posts, replies and quotes) is limited to 30 times per hour per user. Once the limit is reached, you cannot create new posts until a certain time has passed. Uploads that include files are separately subject to the weekly limits of your plan.
2. [File formats and upload limits]
   • Supported file formats: the files that can be uploaded are of five kinds — "STL", "OBJ", "3MF", "STEP/STP" and "IGES/IGS". However, only the three formats "STL", "OBJ" and "3MF" support preview in the browser (the 3D viewer and thumbnails in list screens). For "STEP/STP" and "IGES/IGS" files, only an icon indicating the file format is displayed.
   • Safety-related acceptance limits: A 3MF file is internally a compressed archive that is expanded on the viewer's device. To prevent files that would place an excessive load on viewers' devices, we inspect the internal structure of uploaded 3MF files before storing them and refuse files that fall under any of the following: the total size after expansion exceeds the limit (currently 128 MB); the compression ratio is extremely high; the number of internal entries exceeds the limit (currently 512); the file is encrypted or uses a compression method we do not support; the file lacks the structure required of a 3MF file; or the geometric complexity exceeds the limits (currently 2,000,000 vertices, 4,000,000 triangles and 2,000 objects). These limits may be changed without prior notice in order to protect viewers' devices. Files uploaded before this inspection was introduced are subject to the same inspection the first time a preview is requested; if they do not meet the criteria, only the preview is withheld (download remains available).
   • Limit on the number of files: up to 5 files may be uploaded at once per thread reply. For a standalone post that does not belong to a thread, only 1 file may be uploaded per post.
3. [Rights to delete data and threads, and warnings]
   • Deleting a thread: the thread owner may delete a thread they created at any time (thread participants may not).
   • Deleting replies and individual files: thread participants may delete their own replies, and may also delete individual files within a reply.
   • Deleting a standalone post: users may delete their own standalone posts, but individual files cannot be deleted on their own; only the whole post can be deleted.
   • Confirmation on deletion, and no restoration: in every case, a confirmation screen stating "This action cannot be undone. It cannot be restored." is shown when you perform a deletion. Once deleted, data cannot be restored under any circumstances.
4. Confirmation when uploading to a normal post or a public thread
   • The data is entirely original: it is not a copy of an existing character or of someone else's data.
   • The data does not infringe third-party rights: you warrant that it does not infringe copyright, design rights, trademark rights or similar.
   • No duplicate posting: it has not already been uploaded elsewhere within this platform.
   • Deleting the data, publishing it elsewhere, and restrictions afterwards: you are free at any time to delete this data or to publish or sell it on other sites. However, even if you delete the data from this platform, for example because you later want to distribute it exclusively yourself, you cannot retroactively revoke the personal use rights of users who have already obtained it.
   • Permission for personal use by other users: you allow other users to use it for personal purposes, excluding commercial use (there is no option to allow commercial use).
   • Use of data in public threads and permission to quote and modify: for data uploaded to a public thread, you allow other users to use it (modify and incorporate it) within that thread. This permission always arises the moment you upload and cannot be turned off. In addition, if you allowed quoting and modifying when uploading ("Allow this data to be quoted and modified in public threads" on a normal post, or "Allow quoting and modifying" in a public thread), other users may quote this data into public threads, and you allow it to be used in the same way, including modifying and incorporating it, in the public thread it is quoted into.
   • No dangerous items, harmful programs or illegal data: the data contains no harmful programs such as viruses, and is not a weapon or other data that could be misused for crime or to harm others.
   • Consent to measures in case of violation: you consent to immediate deletion of your account, legal action and claims for damages in the event of a violation of these Terms.
5. Confirmation when downloading from a normal post or a public thread
   • Personal use or thread purposes only (no commercial use): you will use it only to enjoy personally, and never for sale or business use (this does not apply when you use it inside the public thread you downloaded it from, or when you use data marked as allowing quoting and modifying for collaboration in a public thread).
   • No redistribution or re-publishing: you will not distribute the downloaded data to third parties, for example by publishing it on other sites or re-uploading it within this platform.
   • No passing the work off as your own, no undue claim of rights: you will not pretend that you created it, nor obstruct the legitimate use of others.
   • Disclaimer (use at your own risk): you accept sole responsibility for any damage, such as equipment failure or injury, caused by defects in the data, virus infection, or trouble during printing, and you will hold neither the operator nor the creator of the data responsible.
   • How the download allowance is consumed: that week's download allowance is consumed at the moment you perform a download (including individual downloads and bulk downloads). Even if you then cancel in the save dialog on your device, or the file is not saved completely because the connection was interrupted, the count cannot be restored for technical reasons. Please understand this in advance.
   • Consent to measures in case of violation: you consent to immediate deletion of your account, legal action and claims for damages in the event of a violation of these Terms.
6. Confirmation when uploading to a private thread
   • The data is complete and cleared for commercial use: it is either entirely original or consists solely of material explicitly licensed for commercial use.
   • No unauthorized reuse of data from within the platform: data published by other users within this platform is for personal use only, so you will not upload it as commercial development data for this thread without permission.
   • Important warning about trademark and design registration: if you have incorporated external material, you understand that there is a high risk that exclusive rights cannot be obtained, and you will thoroughly confirm the rights involved.
   • Commercial licence, confidentiality, and what happens if the data is deleted: you allow the members of this thread to use and modify this data for the purpose of the thread (developing a commercial product). You can delete the data at any time, but deleting it does not retroactively revoke that permission. You will also treat it as confidential information and will not publish it externally without permission.
   • No dangerous items, harmful programs or illegal data: the data contains no harmful programs such as viruses, and is not a weapon or other data liable to misuse.
   • Consent to measures in case of violation: you consent to immediate deletion of your account, legal action and claims for damages in the event of a violation of these Terms.
7. Confirmation when downloading from a private thread
   • Use for the purpose of the thread and confidentiality: you will use it only to develop a commercial product, and will not leak or publish it externally without the creator's permission.
   • No unauthorized redistribution, no selling the data on its own: you will not distribute it to third parties without permission, nor sell the data on its own.
   • Rights and profit sharing are your own responsibility: trouble such as the sharing of sales profits is to be resolved between the parties concerned, and the operator bears no responsibility.
   • Disclaimer (use at your own risk): you accept sole responsibility for damage caused by defects in the data, virus infection or trouble during printing, and will hold neither the operator nor the creator of the data responsible.
   • Consent to measures in case of violation: you consent to immediate deletion of your account, legal action and claims for damages in the event of a violation of these Terms.

Article 5-2 (Ownership of copyright and the licence granted to us)

1. [Copyright stays with you] Copyright in the data and text a user posts to the Service belongs to the user who posted it (or to the rightful owner) and is not transferred to us by posting.
2. [Scope of the licence you grant us] To the extent necessary for us to provide and maintain the Service, users grant us a free, non-exclusive licence to reproduce, store, transmit, display and convert the data and text they post, for the following purposes. This licence does not permit us to use the data independently beyond what is necessary to provide the Service (for example to sell it, provide it to third parties, or use it in advertising).
   • Storage on our servers and on external storage services, and the creation of backups against failures
   • Transmission to and display for the user and other users who have permission to view (including download and display in the 3D viewer)
   • Format conversion necessary for display, such as generating the thumbnail images shown in list screens
   • Inspection for viruses, harmful programs and files that breach the safety-related acceptance limits in Article 5
   • Responding to reports and checking content that violates the law or these Terms
3. [Duration of the licence and the effect of deletion] The licence in the preceding paragraph subsists while the data is present on the Service and, after deletion, until it has been erased from backups. If a user deletes data, we delete it from our live servers and from the external storage service. However, as set out in Articles 4 and 5, rights of private use already acquired by other users at the time of deletion, and rights of use licensed for joint work, cannot be revoked retroactively by the deletion.

Article 6 (Prohibited conduct)

In using the Service, users must not engage in the following conduct.

• Conduct that violates laws and regulations or public order and morals
• Conduct that infringes the intellectual property rights, privacy or reputation of others
• Posting obscene, violent or discriminatory content
• Posting files containing harmful programs such as viruses
• Developing, sharing or posting data liable to violate laws such as the Act Controlling the Possession of Firearms or Swords and Other Such Weapons (for example data for 3D-printable weapons or dangerous items)
• Using public data on the Service (which is for personal use only) for commercial purposes without permission, including bringing it into a private thread
• Placing an excessive load on the systems or networks of the Service, or unauthorized access such as scraping
• Improperly circumventing the bot countermeasures we put in place (such as CAPTCHA)
• Improperly circumventing limits in ways we do not intend, such as repeatedly posting meaningless data solely to lift a restriction
• Unfairly reporting other users on the basis of false facts
• Transferring, lending or trading an account on the Service, or rights and obligations under these Terms, to a third party
• Any other conduct that we judge to be inappropriate

Article 7 (Measures against violations of these Terms)

If a user violates the consent items applying when creating or joining a thread or when sending or receiving data, or violates any other provision of these Terms, we may take the following measures.

1. Deletion of the thread or the uploaded data
2. Restriction of use of the Service, or suspension or immediate deletion of the account (forced withdrawal). Where an account has been deleted by the operator as a penalty, we restrict re-registration for the Service from the IP address that the user last used.
3. Forced cancellation of a paid plan

[How we decide, notice, and objections] In taking the measures in the preceding paragraph, we will consider the nature and seriousness of the violation, the extent of harm to other users or third parties, and whether it has been repeated, and we will endeavour to keep the measure within what is necessary. Except in the following urgent cases, we will notify the user of the measure and an outline of the reasons at their registered email address without undue delay after taking it.

• Content that violates the law, or that risks harm to the life, body or property of others, has been posted
• We have received a report of infringement of a third party's rights and immediate deletion is necessary to prevent the harm from spreading
• The conduct is causing serious disruption to the operation of the Service

A user subject to a measure may object through the contact desk. We will review the objection and, as a rule, reply within five business days; where we conclude that the measure was mistaken, we will lift it promptly so far as possible (deleted data cannot, however, be restored). Where we have properly taken a measure under this Article, our liability for any resulting damage to the user is governed by Article 8, paragraph 5.

Article 8 (Disclaimers, administration and statistical information)

1. We are under no obligation to review or monitor the content of 3D data posted by users in advance, and we make no warranty whatsoever that such data is complete, safe, or does not in fact infringe the rights of third parties. In the unlikely event of trouble, it shall be resolved at the responsibility and expense of the user who posted the data.
2. [Collection and administration of statistical information] We may collect and view statistical information for purposes such as operating and administering the Service. However, as a rule we do not actively monitor posts and data inside private threads, except where there is a report of a violation of these Terms or similar.
3. We bear no responsibility whatsoever for the use of data downloaded through the Service, for trouble in joint development between users, or for the results of actually printing downloaded data on a 3D printer or similar.
4. The Service is at a stage of continuous development and updating, and functions may be added, changed or suspended, or unexpected defects may occur. We bear no responsibility whatsoever for any resulting damage or for the loss of data in the database.
5. [Exception under the Consumer Contract Act, and cap on damages] The disclaimers and limitations of liability in these Terms (including the parts of other Articles stating that we "bear no responsibility whatsoever") do not apply at all where damage is caused to a user by our wilful misconduct or gross negligence. Furthermore, where the Consumer Contract Act or another mandatory rule of law does not permit our liability to be excluded or limited, the disclaimers and limitations of liability in these Terms do not apply to the extent that they conflict with that law. Where we bear liability for damages towards a user through slight negligence, compensation is limited to ordinary direct damage and is capped at the total fees we have received from that user over the most recent 12 months (or 990 yen for a user who has never subscribed to a paid plan).
6. [Cases in which we issue a refund]Notwithstanding the preceding paragraph, we will refund the relevant amount in the following cases. This provision prevails over the statement that refunds are not available in the "Notation based on the Act on Specified Commercial Transactions".
   • Where a system defect or similar caused duplicate charges for the same period
   • Where, through our error, you were charged for a plan you had not subscribed to, or charged an incorrect amount
   • Where charging continued for reasons attributable to us even though the withdrawal or cancellation procedure had been completed
   • Where, for reasons attributable to us, the functions of a paid plan were unavailable for a substantial period (the amount corresponding to that period)
   • Any other case in which a refund is required by law

Article 9 (Changes to, suspension of, and termination of the Service)

1. We may change, temporarily suspend, or terminate the provision of all or part of the Service at our convenience.
2. Where we terminate the Service, we will as a rule give notice at least one month in advance.
3. We may erase all data upon termination of the Service. Users shall back up their data in advance at their own responsibility.
4. For users subscribing to a paid plan, automatic renewal stops as of the termination of the Service. Fees for the month of termination will not be calculated pro rata or refunded.
5. We bear no responsibility whatsoever for any damage caused by a change, suspension or termination under this Article.

Article 10 (Changes to these Terms)

1. We may change these Terms without obtaining the individual consent of users, in accordance with Article 548-4 of the Japanese Civil Code, where either of the following applies.
   • The change is in the general interest of users
   • The change does not conflict with the purpose for which these Terms were made and is reasonable in the light of the necessity for the change, the appropriateness of the content after the change, the way in which the change and its content are announced, and other circumstances
2. Where we change these Terms, we will announce the content after the change, the reason for the change and the time at which it takes effect, by posting on the Service or by another method we judge appropriate, a reasonable period before the time of effect.
3. Where the change places a material disadvantage on users, we will make the announcement in the preceding paragraph at least 14 days before the time of effect and will also ask for consent to the revised Terms, for example on a screen shown at login. A user who does not consent to the change may delete their account (withdraw) and cancel any paid plan before the time of effect arrives.
4. The revised Terms take effect from the time of effect determined in accordance with the preceding paragraphs.
5. We retain the content of these Terms as they stood before each revision, together with the revision date, so that users can check them afterwards. If you would like to see an earlier version, please contact the contact desk.

Article 11 (Exclusion of anti-social forces)

Users represent that they are not an organized crime group, a member or quasi-member of such a group, a company related to such a group, a corporate racketeer, a group engaging in criminal activities under the pretext of conducting social campaigns, a crime group specialized in intellectual crimes, or any equivalent person ("Anti-Social Forces"). If it emerges that a user falls under Anti-Social Forces, we may take measures such as immediate deletion of the account without prior notice.

Article 12 (Severability)

Even if any provision of these Terms, or part of it, is held invalid or unenforceable under laws or regulations, the remaining provisions of these Terms continue to apply in full force.

Article 13 (Governing law and jurisdiction)

These Terms shall be interpreted in accordance with the laws of Japan. In the event of a dispute concerning the Service, the summary court or district court having jurisdiction over our location shall be the exclusive court of first instance by agreement.
